Concerning the liability of claimants.

Los Artículos 118 y 78
del Código Procesal Penal establecen que en
caso de desistimiento, quienes hubieren
interpuesto la querella con la acción civil
cubrirán a su cargo las costas que
correspondieren, de acuerdo a lo pactado con
sus abogados o lo que defina el juez, de
acuerdo a lo que el profesional respectivo
hubiere efectuado como labor. No se refiere
en ningún momento a un castigo por daños y
perjuicios, como lo quiere dar a entender el
artículo, que pretende desesperadamente
amedrentar a los querellantes que quedan,
para que no retiren la querella. Desde luego
que quienes retiren la querella deberán
pagar a sus abogados por la labor hecha
hasta ese momento y eso es claro desde el
principio, porque contrataron un trabajo y
lo hecho se debe cancelar. Debe quedar claro
que no serán castigados por el retiro de la
querella por el Juez, como erróneamente
afirma el artículo, pues es su derecho
seguir adelante o no y en todo caso el
afectado por la interposición de la querell!

ella es Osvaldo, quien desde luego no se
muestra molesto al respecto y no tiene
potestad para demandar los supuestos daños y
perjuicios.

Articles 118 and 78 of
the Criminal Procedural Code establish that
in the case of a desist, those who filed the
accusation in the civil action will cover
the corresponding costs as agreed upon with
their lawyers or determined by the judge, in
accordance with the amount of work performed
on the matter by the professional. It has
no reference whatsoever to a penalty for
damages or suffering, as the article seems
to imply, and whose intention seems to be to
desperately frighten the remaining filers
into not withdrawing their charges. Of
course, those who have withdrawn their
charges should rightfully pay their lawyers
for the work performed and that amount
should be settled between them. It should
be clear that they will not be punished by
the judge for the withdrawal of their
accusation, as the article erroneously
states, as it is their right to continue
ahead or not, and in any case the only
person affected by the accusation and the
only one who could be offended by it is !
Osvaldo, whom of course is not upset in
that regard and does not now have the power
to file a claim for supposed damages and
suffering.
