Urgent Write-in Campaign
 
 

As has been announced, the Supreme Court decided to hear the oral presentations on December 18, and quite possibly could have a decision on the case after their recess in January.  As such, since this is our very last chance to have input in this trial, the UCCR Board decided to organize a write-in campaign directed at the Reporting (lead) Magistrate of the Tribunal who will hear the appeal.

 The Reporting Magistrate heads the panel of five judges by receiving the appeal, assembling the information, and passing it on to the other four judges who sit on the Tribunal.  A decision is reached by majority consensus of the full panel.

 Our objective with this campaign is to try to reverse some of the misconception the judges might have about the two men: Osvaldo, who has sat in jail for practically 5 years, and Luis Enrique, who has been consistent in his ongoing communications with his creditors, the most recent just days ago.  His messages continue to demonstrate the quality of the man and his sincere intention to honor his commitments.

 The summary we recently provided of the appeal in Osvaldo's defense clearly point out the myriads of legal errors that were committed in this case by the Poder Judicial of Costa Rica.  Disturbingly though, this whole tragedy was not only a clear case of abuse of power by an overzealous prosecutor, but our loss, the loss and suffering of thousands, was degraded and dismissed by an egocentric judicial system more concerned with its righteousness and appearance than justice and truth.

 Your letters may help give a different image of the two brothers, explain why so many of us refused to testify against them, show how fiscal Walter Espinoza coerced people to become witnesses, and how Lic. Acuña obtained hundreds of clients by falsely claiming access to funds and then using his clients as witnesses against the Brothers.   We should remind the magistrates that there are many thousands of us who remained outside the formal legal arena, who continue to reject the false accusations of the fiscal, and who support the innocence of both Osvaldo and Enrique Villalobos.

 This will be your only chance to contribute a personal comment to this case. a case involving the justice system against Osvaldo Villalobos. but in reality also involving his brother Luis Enrique, and all of us, the investors, who have also been the victims of the actions by the Poder Judicial.   It is time to tell our side.

 Instructions:

 Since time is short, with final oral presentations on the 18th of December, we will hand deliver your messages to the court.  You have 10 days to get your messages in our hands.

Express to the magistrate your urgency to have this matter resolved, express your loss in both financial and emotional terms, express your support for Luis Enrique and his brother Osvaldo.  There is no content or length requirement.  It can be hand written, typed, or word processed.  What you say and how you choose to express yourself is a personal matter, but please be respectful and avoid inflammatory language.  Please note that the UCCR board will reserve the right to exclude messages that could provoke a negative reaction or be detrimental to our case.

If at all possible, it would be best if written in Spanish, even in limited Spanish.  If you are unable to write in Spanish yourself, ask a friend, a neighbor, anyone you can find, to help you with a translation.  If all else fails, your native language may be used as second best; but remember, the most important thing is that you write. in any language.  Please note that we cannot translate your letter.
