Holding
Pattern Update
It is a real challenge to
compose a newsletter if there is no news to
report.
As you all know, we have been in a holding
pattern since the appeals in the Osvaldo
case were submitted to the Sala Tercera of
the Supreme Court in December of last year.
Because we (UCCR) have been very silent
since that time, many have written to us to
see if we still had their correct E-mail
addresses. The answer is "yes" to the
addresses. And if there were any newsworthy
items to share with you, we would have done
so.
The only recent event that needs to be
mentioned is a meeting that our attorney had
with Judge Arroyo, the chief magistrate of
the Sala Tercera, in his chambers on April
8th. The invitation to such a meeting had
been extended during our own meeting with
the magistrate. We subsequently met with
José Miguel Villalobos to learn what
happened.
JMV received a warm welcome at the
courthouse. Judge Arroyo asked numerous
questions and showed genuine interest in the
case. The content of the appeals was not
discussed, and our attorney developed no
insight concerning the possible outcome.
The judge did reveal that a court assistant
had been busy compiling a resume of the
appeals for distribution to all the judges
and that this document was 75% completed.
JMV estimated that an opinion might be
anticipated in one to two months from the
time the judges receive the resume. (There
is no legal limit to the time required by
the court to render its opinion.) He also
stated his intention to meet soon with each
of the other four magistrates of the Sala
Tercera.
Just in case we do not have a decision of
the court by the end of May, we will look
into ways to bring pressure as we did before
to bring about the original court case. We
are going on the sixth year deprived of our
savings and that is a very long time... even
for Costa Rica.
