Dear Fellow Investors:
Our mailbox is overflowing. We are delighted
with your response to our proposed lawsuit,
but we also want you to understand that we
are a group of volunteers who lack the
ability to reply promptly to each and every
one of your inquiries and commentaries. It
is probably fair to say that we had no
realistic sense of the volume of work we
were getting ourselves into. Perhaps this
message will serve to pool some answers to
your many questions.
Some of you have expressed concern that our
fee schedule for participation represents
only the beginning of our request for
financial support. Not true. We can now
project that what has or will be contributed
to this effort is adequate to cover the
legal fees as well as miscellaneous costs of
administration. Please remember that UCCR
Board members receive no compensation for
their time, but yet pay n>the same fees for
participation.
Many have sent their applications with all
the required documents except for proof of
investment in the form of copies of
“guarantee” checks, explaining that they
would do so when they returned home from a
winter vacation and were able to access
them. Some lost the originals because of
home theft – usually in Costa Rica – but
regardless, sent their money to us. We have
accepted the application while awaiting a
ruling from our attorney allowing these
individuals to be included in the process
now or at a later date upon receipt of the
check copies.
Also unresolved is whether or not the “total
investment” should be the sum of the
guarantee checks submitted or the initial
investment plus accrued interest. In some
cases this makes an enormous difference.
This, again, will depend upon the advice of
our attorney. For the time being we are
accepting the declaration as stated by the
investor. In all instances where the
documentation is incomplete, we will submit
the application to the attorney. If for some
reason it cannot be included, we will refund
the appropriate fee.
As we have previously announced, the
termination date for acceptance of
applications will be Jan. 31, 2010, based
upon the postmarked date on the envelope.
We are still quite busy tabulating your
data, which is our priority at the moment.
Our goal is to turn over all accounts to our
lawyer by the end of this month. He expects
to have the legal groundwork completed by
that time.

Finally, it will help us if you do not
staple a check. The banks are very
particular about receiving any check with a
blemish. Also, we have discovered that we
misinformed you about the regional code that
should appear in our postal address. Instead
of 20105 it should be 20501. The mistake was
recognized and corrected by the postal
system, so that no mail has been diverted,
but the post office has rightly complained
about the inconvenience we have created.
