Dear friends,
I would first like to communicate to you
that with great faith I believed that the
absolution of the crime of money laundering
handed down in the sentence that you are
familiar with, would open the way for me to
begin to make the arrangements which I have
promised you so many times in previous
letters. Regrettably I have been unable to
make any headway in that regard. I am very
anguished by this situation and I know that
all of you feel the same.
There is no good news to report to you with
respect to the economic component. Thank
God my health is excellent and I have not
lost faith in God, and I know that He will
change this situation. The problem with God
is that He has a time for every purpose, you
and I want a solution now, regrettably we
have to wait for the justice of man and most
importantly for Devine Justice.
As is known to all of you, great efforts
have been made to achieve a solution which
would somehow permit me to honor the
commitments I have acquired with you.
Regrettably until now those efforts have
been fruitless, because we are in need of a
resolution from the court which will permit
it, and although solicited, it has not been
granted.
The current situation is as follows:
1- That in the judicial process being
conducted under unique file number
02-008579-042-PE entered by the Prosecutor's
Office, Civil Defense of the Victim,
Plaintiffs and Civil Actors against Mr.
Osvaldo Villalobos Camacho and others, the
resulting sentence of the Trial Court
Tribunal of the First Judicial Circuit
number 435-07 on 15:00 hours on the 16th of
May of 2007, absolved the accused of the
crime of Money Laundering, convicting him on
first instance for the supposed crimes of
fraud and financial intermediation.
2- That in regards to said sentence as it
relates to the supposed crimes as accused by
the Prosecutor's Office, no Petition of
Appeal whatsoever was filed on the part of
the same Prosecutor or Plaintiffs.
3- That the Petitions of Appeal presented by
the Civil Actors deal with the amounts or
rights they consider themselves to have in
this process, none deal with the accused
crimes.
4- That the only Petitions of Appeal
presented against the convictions in the
first instance were filed by the Material,
Technical and Civil Defense of those charged
in the process.
5- That against the appealed sentence by the
Defense, there are four possibilities for
resolution by the Third Chamber of the
Supreme Court of Justice.
A) Confirm and maintain the sentence and
the punishment imposed such as it was
resolved by the Trial Court Tribunal of the
First Judicial Circuit.
B) Reduce the term of the punishment
imposed on the individual sentenced in the
first instance.
C) Order a new trial, but this time the
prosecutor and plaintiffs may only accuse
for the crimes of fraud and financial
intermediation.
D) Declare an absolution of the accused
based on the allegations made by the defense
in the Petition of Appeal.
6- That the defense lawyers have
insistently solicited the Trial Court
Tribunal of the First Judicial Circuit of
San Jose, to certify that there existed a
definitive absolution of the crime of Money
Laundering, because of the not guilty
verdict declared in the above cited sentence
and the non-presentation of any petition of
Appeal on the part of the Prosecutor's
Office or Plaintiffs in relation to the
accusation of this crime. On the previous
matter the Trial Court Tribunal through
resolutions indicated that it could not make
that certification because the petitions of
appeal presented against the sentence were
taken as a whole and it therefore could not
decide any in partial form.
In light of these circumstances, I rely on
the prayers, patience and serenity of all of
you, because not until the Third Chamber
decides the appeals presented before it, all
of the economic resources will continue
frozen or immobilized. Our hope is that by
next March at the latest we will have a new
sentence and with faith placed in God we ask
and hope He will make justice prevail in
this case.
I attach Psalm 94 so that we may direct our
prayers to our Creator and use this Psalm as
our guide.
Thankful to all of you for maintaining your
confidence in me, I wish you a Merry
Christmas and that next year be the year of
justice, the year of triumph, the year of
the truth.

Estimados amigos,
Lo primero que quiero comunicarles es que
con mucha fe creí que la absolutoria del
delito de legitimación de capitales en la
sentencia que todos ustedes conocen, me
abría un camino para empezar a efectuar los
arreglos que les he prometido tantas veces
en cartas anteriores. Desgraciadamente no he
podido avanzar nada en eso. Esta situación
me tiene muy angustiado y se que todos
ustedes sienten lo mismo.
No hay buenas noticias que comunicarles
respecto a la parte económica. Gracias a
Dios mi salud es excelente y no he perdido
la fe en Dios, sé que EL cambiará esta
situación. El problema con Dios es que El
tiene un tiempo para todo, ustedes y yo
queremos una solución ya, desgraciadamente
tenemos que esperar en la justicia del
hombre y lo más importante en la Justicia
Divina.
Como es del conocimiento de todos ustedes,
se han realizado muchos esfuerzos por lograr
una solución que permita de alguna manera
honrar mis compromisos adquiridos con
ustedes. Desgraciadamente hasta el momento
esos esfuerzos han sido infructuosos, pues
se requiere de una resolución judicial que
lo permita, la que a pesar de solicitarse no
ha sido concedida.
El panorama actual es el siguiente:
1- Que en el proceso judicial que se tramita
bajo el expediente con número único
02-008579-042-PE incoado por la Fiscalía,
Defensa Civil de la Víctima, Querellantes y
Actores Civiles contra el señor Osvaldo
Villalobos Camacho y otros, mediante
sentencia del Tribunal de Juicio del Primer
Circuito Judicial número 435-07 de las 15:00
horas del día 16 de mayo del año 2007, se
absolvió al imputado del delito de
Legitimación de Capitales, condenándosele en
primer instancia por los supuestos delitos
de estafa e intermediación financiera.
2- Que sobre dicha sentencia en lo relativo
a los supuestos delitos acusados por la
Fiscalía no fue presentado Recurso de
Casación alguno por parte de la misma
Fiscalía o Querellantes.
3- Que los Recursos de Casación presentados
por los Actores Civiles tratan sobre montos
o derechos que los mismos consideran tienen
en este proceso, ninguno trata sobre los
delitos acusados.
4- Que los únicos Recursos de Casación
presentados contra los delitos condenados en
primera instancia fueron interpuestos por la
Defensa Material, Técnica y Civil de los
demandados en el proceso.
5- Que contra la sentencia recurrida en los
términos de la Defensa, caben cuatro
posibilidades de resolución por parte de la
Sala Tercera de la Corte Suprema de Justicia.
A) Confirmar y mantener la sentencia y la
pena impuesta tal y como fue resuelto por el
Tribunal de Juicio del Primer Circuito
Judicial.
B) Reducir el tiempo de la Pena impuesta
al sentenciado en primer instancia.
C) Ordenar un reenvió (nuevo juicio),
pero esta vez solamente podrá acusar la
fiscalía y querellantes por los delitos de
estafa e intermediación financiera.
D) Declarar una absolutoria del imputado
fundamentada en los alegatos de su defensa
expuestos en los Recursos de Casación.
6- Que los abogados de la defensa
insistentemente solicitaron al Tribunal de
Juicio del Primer Circuito Judicial de San
José, certificara que existía una
absolutoria definitiva del delito de
Legitimación de Capitales, en razón de la
absolutoria ya declarada de la sentencia
supra citada y de la no presentación de
ningún recurso de Casación por parte de la
Fiscalía o Querellantes en relación a la
acusación de este delito. De la anterior
gestión el Tribunal de Juicio mediante
resoluciones señaló que no podía certificar
por cuanto los recursos de casación
presentados contra la sentencia lo eran en
un todo y por tanto no podían resolver ellos
en forma parcial.
Así las cosas, acudo a las oraciones,
paciencia y serenidad de todos ustedes, por
cuanto hasta que la Sala Tercera no resuelva
las apelaciones presentadas ante ella, todos
los recursos económicos continuarán
congelados o imposibilitados de movilización.
Nuestra esperanza es que para el mes de
marzo próximo a más tardar contemos con una
nueva sentencia y que con la fe puesta en
Dios pedimos y esperamos haga justicia en
este caso.
Adjunto el salmo 94 para que todos dirijamos
nuestras oraciones a nuestro Creador y que
usemos este Salmo como guía.
Agradecido con todos ustedes por mantener su
confianza en mí, les deseo una felíz navidad
y que el año que viene sea el año de la
justicia, el año del triunfo, el año de la
verdad.
