It is time that we attempted
to answer your FAQ’s of the
past several weeks.
1. Several of you have
suggested that the one-year
period for the statute of
limitations on another
lawsuit might expire before
such a suit could be filed.
We have inquired about this
possibility, and the
prevalent opinion is that
the current lawsuit serves
to keep the case open, and
that the time period for a
new lawsuit would begin with
the date of termination of
the present one. We need to
emphasize, however, that our
experience has shown that
legal consequences in Costa
Rica are very difficult to
predict, and there is no
assurance that an event will
happen until it has already
done so.
2. You are asking if we
have heard from LEV recently
or if we know what his
present circumstances are.
Our answer to both questions
is “No”. The last
information we had about
Enrique was in September of
2009 when he advised that he
could no longer communicate
because it had become too
risky for him. We do not
know where he is or the
state of his health. We
believe we would be likely
to hear about it if there
were any serious health
problems.
3. You have also asked if
the documents promised us by
the Court have been
received.
The answer again is “no”.
Despite daily trips to the
Courthouse to check, we are
still empty-handed and do
not know why. We are only
told that it takes a lot of
time to assemble and
organize the voluminous
record of the Oswaldo case.
Meanwhile the hearing phase
remains suspended.
