We've Waited Long Enough
It has been some time since
we last communicated with you, hoping we
would have been able to announce a date for
trial by now. Unfortunately, this is not
the case and we are once again stuck in a
judicial process which has been cumbersome
and inefficient, at best. The constitution
of Costa Rica guarantees the right of every
person to have a prompt and thorough
judicial process. Certainly, this process
has failed to honor this guarantee.
For this reason, WE
NEED YOUR HELP.
We must call on you
once again, as we have in the past. We
need groups of 3-5 investors go to the
court system's Contraloria de Servicios
del Poder Judicial to file complaints (quejas).
The purpose of this office is to receive
and resolve complaints and problems
about cases stuck in the judicial
process, like ours.
The Contraloria de
Servicios has two offices:
Edificio de la
Corte Suprema (Av 8 & C 19),
1st floor in the
rear (some English spoken).
Tribunales de
Justicia building in San Jose
(Av 8 & C 17),
1st floor in the rear
(Spanish only).
Offices open 7:30 to
4:30.
We need a good
presence, a steady group of investors if
possible, during the next two weeks, to
file complaints against those who are
responsible for assigning the date of
trial. We have waited long enough...
two months since the appeals from the
Preliminary Trial were resolved, four
months since the end of the Preliminary
Trial... still, no trial date.
Enough is enough. We
need YOU to become a "group leader"!
Each group leader
should organize a group of 3-5
investors. It would be helpful for each
group to have at least one spanish
language speaker. Mientras mas Costarricences
se presenten para reclamar sus derechos,
mas atencion nos daran. Por favor,
vallemos todos para que nos eschuchen!
Let them know
you are investors with
Villalobos. Let them know you
have been waiting for more than
three years to see the end of
this case. Let them know you
need the trial to start as soon
as possible. Let them know the
court needs to assign a date of
trial so your waiting can come
to an end. Above all, please be
civil, but make your sense of
urgency known. Keep in mind
that this office is there to
assist you. It is not their
fault we have waited so long, so
don't take it out on them.

The queja will be taken
in an oral fashion. You will not need
to fill out any paperwork. The court
representative will take notes on your
complaint, and your names and contact
numbers. Remember that you are indeed
an affected party in this case, and
although you did not file a denuncia
against Osvaldo or Enrique, access to
your life savings was frozen by the
government until the end of the trial.
Make sure you take the above information
with you.
IMPORTANT: Using the
group leader's first letter of
your last name, try to loosely
coordinate your visit to the complaints
office on the following schedule:
A-D: Wednesday, 14 Dec
E-H: Thursday, 15 Dec
I-L: Friday, 16 Dec
M-P: Monday, 19 Dec
Q-T: Tuesday, 20 Dec
U-Z: Wednesday, 21 Dec
All: Thursday, 22 Dec
If you cannot meet our recommended
scheduled time, GO WHENEVER YOU CAN
during this time period. The purpose of
this schedule is not to limit your
visits, but to avoid too many of us
showing up at the same time, and delay
each other when we file our complaints.
WE NEED AS MANY OF YOU AS POSSIBLE FOR
THE MOST IMPACT TO MAKE OUR PRESENCE
KNOWN.
