We have been informed
that the process of appeals has
concluded, and further, that all such
appeals were ruled in favor of the
defense.
This means that in every instance where
Judge Castrillo of the Intermediate
Phase (the Preliminary Trial) rejected
an investor's claim of fraud against the
brothers Villalobos, the appeals
tribunal agreed with the judge, and
those claims have now been dismissed.
We should point out that in the majority
of those cases, the reason for the
dismissal was because the investor's
claim was made against Enrique
Villalobos, who will not technically be
on trial in this case.
This also means that the road for a date
of trial has finally been cleared, and
although we should not expect a quick
turn around, as we have unfortunately
learned time and time again after three
long and frustrating years, that date
finally approaches ever closer. We are
anxious to get this trial under way.
The defense is hopeful that the tribunal
who resolved the Preliminary Trial
appeals will be the same tribunal
assigned to the Oral and Public Trial.
That tribunal, known as Group 5, is
comprised of two women judges, Ligia
Arias and Janette Villareal, and one
male judge, last names of Rojas Saldas.
They are considered fair and unbiased by
the defense.
